All Abilities Park Highlights City's Character


December 12th council meeting included a brief update on the progress of making the ALL ABILITIES PARK a reality. Kent Perkins, Director of Parks and Recreation for the past 31 years touched on ideas presented by the public and the contribution being made by a non-profit agency (Change Inspiration) from California. Citizens of St. George and surrounding communities were asked to provide what they thought to be valid and significant features for inclusion of elements and design features for children with Special Challenges. 

Mr. Perkins pointed out the importance of determining what we (the "City") can afford and what Private Donations will contribute. The City is expected to contribute from Park Impact Fees and monies received from the sale of city properties. Parents of children with special needs were asked what they would like to see their children experience and one suggestion was a swing for wheelchairs, that children might experience the feeling of swinging on a tree. 

NOW, my friends I know from practical life experience that we (tax paying citizens) do not all share the same values on the use of government funds and how they should or should not be spent, but I can tell you that from the first presentation of the concept of "An All Abilities Park" that took place about two years ago that this idea brought forth by Mr. Perkins has touched the hearts of those in attendance, bringing tears to their eyes with the thought that shows the heart and soul of our community. I believe it sets us apart from other cities and is a clear display of culture values and is what makes St. George a desirable place to live.

The theme of All Abilities Park has yet to be decided upon and while it may include a Southwest Desert Theme or even a Dinosaur Theme. What is important is that it will clearly make known, now and forever, the true  character of the city of St. George and its people.

It’s good. It improves Our Quality of Life by bringing us all together.

It is important to note that development of this park includes an expectation/ opportunity for active participation from children with special needs as well as the Business and Industrial Community. No contribution will be considered too small or too big. It brings out the best in us. We may have different abilities, gifts or talents but, remember we are ALL in this together. Improving our community and making the world a better place to live.

The Mayor and outgoing Council Members sang their Swan Song and received due recognition for their service and accomplishments.

The New Year will bring forth a new and refreshing city government. It is expected that tradition and culture values will remain intact.

ON January 6th at Noon swearing in ceremonies will be held at City Hall, Council Chamber Room. Jon Pike will become Mayor and Randall and Bowcott will become our new City Council Members.

Qualified residents of St. George will be invited to apply for the city council seat vacated by the appointment of Jon Pike as Mayor. Utah Election Laws are to be followed and are to be supervised by City Attorney Shawn Guzman.

Candidates are expected to have until January 20th to file for this position and will serve the remainder of Pikes term, 2 years.

On January 23rd City Council Meeting the vacated council position will be filled and the 5th council member will be sworn in. We are off and running with high expectations. Happy New Year.

Freedon Heard in City Chambers

December 12th City Council Workshop Meeting began in the City Hall Lobby with my meeting Sheila Smith, representing The Christian Science Society of St. George and member of the Inter-Faith Churches that represent St. George at large. This was to be the third year Ms. Smith was to give the invocation at the beginning of the City Council Meeting.

Also gathering in the lobby was the Pine View High School Choir who had been invited to sing before the council. No finer gathering of youth will you ever find than these young men and women. What an outstanding display of talent.  KUDOS to Pine View High School.
The beautiful sound of FREEDOM was heard as recognition came when the Choir sang CHRISTMAS SONGS and the INVOCATION spoke to what Christmas celebrated.  My friends, the fact that we as a city, as a nation, can still gather and hear expressions that we may not all appreciate or find value in is a monument to what America is all about. Yes, this is still able to take place in a public City Hall building.  We truly appreciate our city values.
The Council Workshop meeting moved from the council chambers into the conference room for presentation of agenda items.  Notably absent was the mayor… Who’s strong personality I am already starting to miss.
Gayle Bunker served as Mayor Pro-tem and a quorum consisted of Jon Pike, Ben Nickle, Gil Almquist, Jimmy Hughes.  Also present were council elects Randall and Bowcott.
I could not help but notice the soft tone of voice employed by City Manager, Esplin as the meeting moved forward. First on the agenda was a frank discussion on the improvement needs of the St. George Recreation Center.
It was reported that the city purchased the building located on 400 East in the year 1993 at a cost of $l.00.  This being the old National Guard Armory building that was improved upon for city recreational needs. The bottom line was that during recent refitting, foundation issues became apparent that forced work to stop.
To make things right an additional $167,000 will be needed; extending the cost to $211,000.  This money is to come from the city’s Capital Project Fund. City Manager Esplin brought attention to the fact that the city makes an effort NOT to compete with Private Business in the field of recreation and city expenditures over the years have been quite modest.
The council determined that although this year’s current budget does not included money for this newly discovered  recreational need, improvements should move forward.  The city has certainly gotten its monies worth from its original investment of $1.00.
Agenda item 2 was tabled and discussion on Cremation Gardens at Tonaquint Cemetery will be rescheduled.

City in Motion

December 5th City Council Meeting had a joyous atmosphere to it. Perhaps the CHRISTMAS SPIRIT was bringing out thoughts in people’s minds as to what is REALLY important in the lives of each individual. GOOD.

As I searched the room I noted the presence of St. George Police Department in the attendance of Deputy Chief, Rich Farnsworth. DO YOU know that each council meeting includes a police presence? Usually, Chief Marlon Stratton or Deputy Chief Farnsworth sit in the back of the room, out of camera range. TODAY was especially meaningful for Deputy Chief Farnsworth because it marked his 20 year anniversary with SGPD. Congratulations for your service to the citizens of St. George! We are grateful for your service; not to mention countless hours spent at city council meetings after completing a full days work.

It was duly noted that council elects Randall and Bowcutt were in attendance and preparing for taking office. BY THE WAY folks, this is UNUSUAL to see those who are yet to take office showing up regularly. The first time I saw Gayle at a meeting was when she showed up to get sworn into office. This can be taken as a positive sign of willingness to serve.

In the background one can see the presence of an individual coveting the soon to be vacant position when Councilman Pike becomes mayor. The wheels are in motion by those seeking the position and/or Special Interest Groups seeking to exercise their influence. It will be interesting to see how this plays out.

HIGHLIGHTS of today's Public Hearing had to do with a zone change request put forth by IHC Health Services and the LDS Church on a vacant lot located at the corner of 200 East and 600 South; just down the street from The Church of Jesus Christ of Latter Day Saints -LDS- Temple.

This property is currently designated Residential Central City and is to be changed to Administrative & Professional use to permit the building of a New State of the Art Facility. A NEW FAMILY HISTORY CENTER considered to be A First of Its Kind. WOW!

It should be noted that Councilman Pike expressed a conflict of interest in that he is employed by IHC and left the Council Chambers. The vote was cast and the matter was unanimously approved, and rightfully so.

DO YOU KNOW that while some may say this is a self- interest promotion on the part of the LDS Church, that a GREATER number of NON-LDS MEMBERS use the LDS FAMILY HISTORY CENTERS for their genealogy at No Public Cost?

Concerned citizens expressed their public safety interest for pedestrian and wheelchair bound elderly, as well as for building design and ascetics. The public was reassured that all of their concerns would be addressed and expectations are that all will be pleased with this great addition to the City of St. George.

The second Public Hearing had to do with a zone change request from Administrative and Professional to Commercial C-4 was a Historic Landmark Site Residential Building located at 214 East Tabernacle Street. Martin Lustig was the applicant and was given recognition for his efforts by
the council who approved his request.

FOLKS, we need to keep our eye on zone change requests; particularly those in the Downtown portion of the city, especially as the city moves to recognize the need for MIXED USE buildings. This is sure to be on the Council’s Agenda this coming year and should be recognized and acted upon.

We look forward to seeing the details on the proposed Wilkinson’s Commercial Development hopefully this coming year.

Declared Conflict of Interest

City Council Meeting of November 21st. presented me with the opportunity to reflect on the past and current members of the City Council. Going back ten years, I could not help but notice the change of methodology employed which brought forth the personalities of each member and their posture in presenting themselves. The Individual Values and Concerns for the Image they portrayed of themselves, To not only to be SEEN, but to be HEARD displaying those qualities. A GENUINE attitude that they care how the PUBLIC perceives them and their actions.

This observation was made during Public Hearings on two issues that may on their face appear minor or of small importance on zoning issues.
The first issue had to do with change from R-1-10 to AP on 15.77 acres and to OS on 28.77 acres on property located on the east side of Medical Center Drive at approximately 600 South.   (East of the new Hospital)
What made this meaningful was that IHC Health Services, Inc. was the applicant and that Councilman Pike, now Mayor Elect Pike is employed by IHC.
What stood out was that Councilman Pike clearly made it known that he was Excusing Himself from voting, but then to avoid any semblance of Conflict of Interest or Undue Influence on other Council Members he left the Council Chambers to allow the issue to be heard.
The second issue had to do with change from RE-12.5 to R-1-10 on 5.01 acres located on the east side of 2160 East Street and north of 2450 South.
What made this meaningful was that Denice Hughes was the applicant and that he is brother to Councilman Hughes, who followed the example outlined by Councilman Pike.  He too declared a Conflict of Interest and left the Council Chambers.
How refreshing to see that both men not only complied with protocol but that they did it in such a way that their Character stood out in a most positive way.
This can only bode well for the citizens of Saint George but it also stands as a good example to be followed by our recently elected council members, Randall and Bowcutt.
There was a third zoning change issue which took place during this council session that had to do with a change from RE-12.5 on 10.6 acres and from A-1 on 11.9 acres to R-1-10 located southeast of the intersection of Seegmiller Drive and 3000 East Street, south of the Bridle Gate Estates. Borely Enterprise Trust, Charles Larsen, Trustee was the applicant.
What stood out on this issue was that several citizens from the adjoining properties were present and contested the zoning change.  Both sides of the issue presented their arguments with a high degree of quality of expression and with civility.
What was most meaningful to me was that approval would bring with it an increase in density with a projected increase of 8 additional lots.
NOW, as expected Councilwoman Bunker put forth the effort to mollify both sides of the issue and the other council members contributed by recognizing past zoning efforts in this part of the community.
WHAT REALLY stood out was Councilman Jimmy Hughes who had the courage to speak out. Revealing his personal values and what he recognized as being in the best interest of the Little Valley community, while voicing recognition of past and future building expected in this area of the city and while acknowledging that he owns property in this area and what he would like to see for his family and friends. A quality of life which he and his family cherish.
My friends, isn’t it nice to see and experience a true sense of transparency take place in OUR city council meetings.

Kindness Expressed at City Council

November 21st:
Council Meeting began for me when my attention was drawn to Allison and Tom McArthur (husband and wife) quietly seated, awaiting the start of council proceedings. I usually expect to see them at McArthur Jeweler’s on Main Street, but today I was taken with the soft, kind expression their faces revealed as they patiently waited for their turn to address the Council. One cannot help but be moved by an obvious sign of love and affection two people may have for each other.

I was not surprised to learn that their presence had to do with seeking City approval and sponsorship for the 2nd Annual Christmas Stoll Downtown Event to be held Saturday December 7th.

Approval was being sought for closure of city streets and City Sponsorship to highlight the Holiday Experience. The city wisely approved the invitation to be a part of activities that bring together the entire city.

The City agreed to match the funds expended by the Downtown Merchants, not to exceed $2000.00, and to make available the Stage for musical entertainment that is sure to bring forth the Christmas Spirit.

Tom and Allison were properly recognized for their public service that extends beyond providing for the young and old of the community. It was a nice touch to get us all feeling the Holiday Spirit and for providing an opportunity that ALL of us may come together as a City Family.

IT’S ONE OF THE MANY REASONS WE CHOOSE TO LIVE IN SAINT GEORGE.

We may question the expenditure of city funds and surely we will not all be in agreement with where the money goes, but this Council meeting also included The Annual Audit Report for fiscal year 2013. Please note that the City of St. George received the highest possible evaluation.

OUR CITY’S financial affairs appear to be in order and well managed. This was further made evident by the approval of a resolution to adopt what amounts to a refinancing of $13.000,000 in Electric Revenue Refunding Bonds intended to provide 6% Annual Savings that may total $600,000.
KUDOS to City Staff.

Speaking of good news, the City received notice from Fish & Wild Life that the permit for building of the Mall Drive Bridge may be rendered in 2 to 4 weeks allowing for bids at the first Council Meeting in December. This makes it possible for the City to receive the benefit of roughly $3,000,000 less than the City Engineer’s Estimate Cost of Construction.

Recognition was given to the City of Washington who made this possible by cooperating with building efforts. The building of Mall Drive Bridge in 7 months is sure to improve transportation needs for Washington and St. George residents. GOOD GOING WASHINGTON CITY.

The positive spirit of Transparency and Cooperation appears to be building up as we move to a new year and a new era of City government.

Upward and Onward - Promises Made & Promises to be Kept

The regular Council meeting on Thursday, November 14th Administrative Conference Room, St. George City Hall.

Notably absent was the Mayor, who has now missed the past two Council Meetings (reportedly
attending a Conference in Texas) and Councilwoman Bunker, who’s
husband is said not to be doing well. We wish them both the best.

A quorum was made up of Council persons present; Jon Pike, Ben Nickle, & Jimmy Hughes. It fell to Councilman Pike to serve as Mayor Pro-tem and late arrival Gil Almquist made up the quorum. Mayor Pro-tem Pike graciously invited Councilwoman Elect, Michelle Randall to join them at the table. Councilman Elect, Joe Bowcutt was not able to be present and we wish him well with his back injury.

The meeting began with the council certifying the St. George Official Election Results. The final numbers did not change the results and they were presented as follows.:

City Mayor:
Jon Pike 8409 (61.09%)
Dan McArthur 5314 (38.60%)

City Council:
Michele Randall 7973 (31.74%)
Joe Bowcutt 5893 (23.46%)
Tara Dunn 5608 (22.33%)
Ed Baca 5579 (22.21%)

The filling of Councilman Pike's position on the council is yet to be done and is expected to take place this coming January when the newly elected council will cast their votes to elect Pike’s successor.

While the Council may select from the list of applicants expected to apply for the vacated position I feel it appropriate to state that Council Candidates, DUNN and BACA should be given primary consideration based on the votes garnered this past election that reflects the will of the people. I would feel comfortable with the selection of either DUNN or BACA and will of course support whoever the City Council appoints to this position. YOU should feel free to express your opinion on this matter to the newly established Council.

Having placed the election of new city officials behind us it is time to look ahead. The path to improved public relations and involvement appears to be the order of the day. HOT off the plate was a presentation made to the Council by Kendall Clements who represented “Escape Properties”, on the issue VACATION RENTALS. This has to do with property management of 2nd homes who wish to rent their residential or townhomes to those coming to visit or vacation in St. George.

Short Term Housing…renting homes for 1, 2, 3 Days? Mr. Clements referred to City Ordinance (SGC 10-14-22. Short term rental is usually considered to be less than 29 Days. The question was raised should “Conditional Use Permits” or “City Issued Licensing” be allowed to regulate the City Rental Ordinance? What value is to be given to a “PD” or Single Family Zoning? This of course begs for a discussion on WHY the City should have Zoning Ordinances. The collecting of REVENUE came to the forefront. Are we to drive the rental of homes further underground and thus lose needed revenue? Should a home buyer REALLY have an expectation to be able to raise their family in a residential/family community or is this to be trumped by the need to make as much money as possible for the Board of Realtors/Property Owners and Property Managers as mentioned by Mr. Clements. It was duly noted that Mr. Clements touched on his personal experience dealing with City Code Enforcement Officers and lack of acceptable public relations skills or respect given him.

This brings to light the REPEATED call I made during this last election, citing the need for Boards and Commissions. Namely a Human Relations Commission and a CITY ORDINANCE and ENFORCEMENT COMMISSION.

VOTERS must remain diligent in monitoring “PROMISES MADE & PROMISES KEPT” during this last election.

Gratitude

As we find ourselves enjoying the warm, embracing weather that only St. George can provide in November, one has to feel a spirit of gratitude for the beauty that surrounds us. 

 Each of us possesses within ourselves, the level of appreciation to be given…….and I believe we each know who is to be the recipient of our heartfelt Gratitude. 
I am grateful that on November 5th we were able to exercise our freedom and VOTE for the candidate of our choice.  Those elected to public office have assumed a great responsibility…….  Given to them by those who entered the voting booth, in equal standing with fellow citizens, regardless of wealth or station in life……each had but one vote to give, no more and no less than their neighbor.
 We should all be grateful that we live in a country that allows us to exercise this very special freedom. The first step is taken when we vote. The next step is to sustain those we voted for by contributing with an oversight that will enable them to measure the actions they take on the public’s behalf.
As Thanksgiving Day approaches I pray that we as citizens of St. George will come together to help improve and strengthen the fabric that makes this community the most desirable place to live, work and raise our families.
Thank you one and all, present and past citizens of St. George for the contributions and sacrifices made and for those yet to be made. The future of St. George is bright not because of who was elected…… but because of the PEOPLE who make up this community we call St. George.

Our Responsibility to Vote

My friends and neighbors, I was struggling to find words that describe the distasteful and humiliating situation this general election has brought out, that has reflected so badly on our city.  Acts/or Failures of our city government, Intended or Unintended, are none-the-less undesirable and unwanted.

It has been made clearly evident that the DIXIE AMBULANCE ISSUE, THE ANIMAL SHELTER ISSUE, THE PROPERTY RIGHTS ISSUE, THE CONFLICT OF INTEREST, AND SELECTIVE ENFORCEMENT ISSUE (which is now capped off with a pending civil suit that may cost the city and taxpayers thousands of dollars) is now confronting voters and begging for a solution.
As if this is not enough to bring you to your knees, the ugly allegation that city ordinance violations may have been perpetrated by an elected city official has now caused members of the community to demand an investigation of possible criminal behavior. WHAT are we citizens to do to rectify the mess we find ourselves in?
I mentioned that I was seeking the words to better express myself in reporting Chamber Activities when I happened to pick up my new cell phone seeking weather report on strong winds.

I don’t know what button I touched or what I did to bring to the screen a photograph of Thomas S. Monson, but there He was...facing me, and in large bold letters the words appeared stating “OUR RESPONSIBILITY TO RESCUE”
NOW, let me say that I STRONGLY believe in the Separation of State and Religion, but as I read the words I thought to myself this describes what is needed to be done in this General Election.
In my mind I changed the words of saving an individual spiritually into saving the City from further debacle of inappropriate governing.
I called out to my wife and told her what had happened.  She replied you were seeking an answer and you got it.  Follow your promptings.  Having been married 53 years I decided to follow my wife’s counsel.
So here goes the message I wished to send to VOTERS addressing the dilemma you may find yourself in when casting your ballot.
Please consider OUR RESPONSIBILITY TO RESCUE THE CITY… From City government that may have strayed from righteous behavior for one reason or another. From those that may have separated themselves from activity that provides fair, and honest, clean exercise of power when governing.
The City is almost certain to remain lost unless there awakens in us “VOTERS” a desire to rescue and save our City from further appearances of wrong doing.
Our task is not insurmountable, we “VOTERS” are acting to exercise our Constitutional Rights, our Best Judgment, by casting a VOTE for Good City Government.
VOTE NOVEMBER 5TH for the candidate YOU judge will to be most capable of representing your values and principals when conducting city business.

A New Broom Sweeps Clean

The newspaper headline calls for POLICE INVESTIGATION of city officials, MAYOR and A Sitting COUNCILMAN included.

Your first response to stunning allegations of misconduct may be to ask yourself, WHAT IS GOING ON IN OUR CITY? 
How could things have gone so bad so quickly without the public knowing about it?  It may very well be that THINGS like SELECTIVE ENFORCEMENT have been going on for a long time but in this new era of communication, incumbents can no longer keep a lid on THINGS as they have in the past.

Using clichés like "You Can’t Put the Toothpaste Back In the Tube", OR "now The Cats Out Of The Bag"...The question is HOW do we choose to deal with this developing crises in city government?
May I respectfully remind citizens that in our judicial system of governing we have traditionally allowed that a person IS to be presumed INNOCENT until proven GUILTY.
We may take solace in knowing that this Election there are NO incumbents for City Council running for re-election and there will be a New Broom cleaning City Hall.
The call for police to investigate allegations involving the Mayor brings forth the issue of CONFLICT of INTEREST.  Should the Chief of Police or City Attorney be placed in the position of investigating or prosecuting their Boss?
This on its face appears highly inappropriate. Please note that Utah Election Laws, section 10-3-928 (2) (Duties of City Attorney) reads……May prosecute under state law, infractions and misdemeanors occurring within the boundaries of the municipality.  The key word is MAY.
Sub section (6) reads, may designate a city attorney from another municipality or a public prosecutor to prosecute a matter, in the court having jurisdiction over the matter, if the city attorney has a conflict of interest regarding the matter being prosecuted.  CLEARLY A CONFLICT OF INTEREST exists for both the Chief of Police and City Attorney.
It is time to have an INDEPENDENT investigation conducted on all matters that have been brought to the forefront during the past few months. It’s the RIGHT thing to do.

Tough Love for Those Entrusted to Protect & to Serve

During the course of this Municipal Election, Code Enforcement of City Ordinances has repeatedly come to the forefront. As might be expected, the procedural process for adopting laws and establishing enforcement guidelines have rested solely on the shoulders of City Staff with final approval being voted on by 5 sitting council members.

Policy and Procedures & Rules and Regulations are to be developed and supervised by the City Manager and Department Heads. Employees are expected to be trained and educated on elements contained in each ordinance. Employees are then to conduct themselves accordingly; keeping to prescribed job performance expectations.

LET US NOW DIRECT OUR ATTENTION TO THE VERY IMPORTANT ISSUE OF PROPERTY RIGHTS and GOVERNMENT.

Particular attention to Property Rights and Code Enforcement is warranted, due to the recently filed Class-Action Law Suit naming the Mayor and City of St. George as defendants. Transparency on this issue is very important as it may very well cost the taxpayers a large amount of money to litigate this issue.

HOW DID WE GET IN THIS POSITION AND HOW COULD WE HAVE AVOIDED/PREVENTED IT FROM HAPPENING?

May I humbly suggest that we find ourselves in this predicament because those that have been entrusted to lead have succumbed to worldly temptations of power and have stopped LISTENING. I can vividly recall in my boyhood when I ceased to listen and adhere to the course I was expected to follow, my dear mother would say to me, “You are getting too big for your britches.”
Well, without describing in detail the failures that have led to the city being sued… the kindest way to put it, is to say, the predicament our City now finds itself can best be presented in the simplest and kindest terms by stating… The Mayor and City Manager appear to have gotten “too big for their britches.” As made evident by current events.
They no longer are LISTENING and more importantly RESPONDING to the folks who put them in office; they know better.
The Mayor and City Manager have grown too big to spank. There is an alternative.   It’s called an ELECTION!

Issues highlighted during this election cycle have been very disconcerting and troubling to say the least.
What has become Important in this election is that we, the people, can correct wayward, inappropriate behavior by putting individuals in office that WILL Listen, Hear, and Act in a Responsible way…And YES, be RESPECTFUL to the public when doing it.
The Mayor and City Manager should follow a mother’s admonishment.

REMEMBER WHO YOU ARE!

The Shame of It All

Right Here. In our beautiful community of St. George, I have come to feel the shame that many of us are sharing with what is taking place in the greater USA. 

I am not referring to the most recent despicable act our Federal Government has taken; a slap in the face delivered to Our American Veterans… The lack of respect to our fallen soldiers… It is enough to bring tears to the eyes of those of us who love our country and the Principals for which, It stands. 
Regretfully I am referring to the growing evidence and/or sequence of current events which reflects the Character of Our Municipal Government.
 1.  The alleged acts occurring at the St. George Animal Shelter revealed that the investigation conducted by our police department came to an end as the allegations of inappropriate or possible criminal behavior could not be substantiated by witness statements… as those seeking justice were made to feel threatened or coerced by the insensitive statements of an elected city official.  This in and of itself is insufficient to cause a feeling, or to concluded poor or shameful behavior on the part of municipal authority as a whole.
 The acts occurring were compounded by continued hints that potential witnesses to reported allegations had caused city employees or volunteers who may have witnessed acts under investigation not to come forward, but instead elected to remain silent for fear of reprisals or loss of their jobs. 
2.  The allegations of violation of 4th Amendments Rights. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures, shall not be violated. 
The questionable behavior alleged to have taken place by municipal authority ( Code Enforcement Officers) acting and following practices approved and authorized by those empowered to represent City Government cannot but bring attention and raise concern to City Government behavior with the recently reported threat of a class action suit to be filed against the city in which citizens were alleged to have been fined inappropriately and experienced a repressive behavior allegedly caused at the hands of City Government.

The benefit of doubt remains... as being incomprehensible, that OUR CITY Government has been given to malpractice or misconduct in governing and has given a free hand to those hired to supervise city employee behavior. 
In the interest of justice and fair play the benefit of doubt is given to City Government as personal emotions and just plain misunderstanding of motives may have a bearing on reported issues.
The SHAME OF IT ALL is manifested in item number three which tends to substantiate a pattern of behavior which is abhorrent to the American Public and most importantly the Citizens of St. George.
3.  The First Amendment to the Constitution of the United States of America. Congress shall make no law respecting an establishment of religion, or PROHIBITING THE FREEDOM OF SPEECH, OR OF THE PRESS.
That the Assistant to the City Manager has taken it upon himself to write the following to a member of the Press…..without explicit authorization from the highest authority within City Government is thought to be unthinkable if not unbelievable.

On October 27, 2013 at 4:05 P.M. the following email was sent to a member of the Press.

“I was reading the Senior Sampler date September 27, 2013 and came across the article, News from City Chambers by Ed Baca."

“I don’t have a concern with the article itself but I do feel that the title is misleading. It sounds as if the article is an official piece of information produced by the city which it is not”.

“Please consider changing the title to better reflect the information”.

Had the Assistant to the City Manager stopped here, perhaps, even during this current city council general election which is now in progress could be understood and explained away.

However, he did not stop.  Instead, censorship was exercised as he continued to write.

“Please consider changing the title to better reflect the information. If you would like something official from the City on golf or any other topic please just ask me”.

The writer has crossed the line, infringing on Freedom of The Press.  But, he did not stop. He continued.

“If you prefer to just cut and paste from a legal city contract or agreement and call it an article I can do that as well”.

In other words Government will provide material you can print. And if this were not enough censorship and coercion he continued to write.

“These public documents are available to anyone who requests them and if a number of people are interested in reading them through your publication I would be happy to assist."

It was signed, Marc M. Mortensen, Manager of Support Services. The city logo was affixed to the bottom of the page.
I find it reprehensible that a representative of City Government would on city time endeavor to apply undue influence as to what and how a Free Press presents news in an apparent effort to direct the outcome of an upcoming election.
Clearly a pattern of behavior outlined in three specific incidents cannot be ignored and one can only regretfully conclude that all indications are that we as citizens of St. George have been shamed by the behavior of our City Government.  Intimidation, violation of Constitutional Rights cannot be condoned or tolerated.

It is with great sorrow that I have found it necessary to bring these matters to light.

Code Enforcement Commission to Save the Name of The Good Old Boys

Having spent the last decade listening to countless efforts to DEFAME the GOOD OLD BOYS of our great City…I have come to realize that the name has a broader meaning throughout the nation.  I TOO AM A GOOD OLD BOY !

I feel I am able to say this because I represent the character of a Good Old Boy; someone who Believes in God, Believes in Family Values, and WHO LOVES HIS COUNTRY. 
There are a whole lot of us who can relate to these values. Both men and women can proudly say they are, in their own way, a GOOD OLD BOY.
At yesterday’s City Council Meeting (Oct.3rd 2013) as I listened to our present mayor I recalled him recently stating, and laying claim to being a Good Old Boy.  Well, there sure are a lot of us who are.

Which brings me to my point.   When actions are taken or postponed by duly  ELECTED officials and others under their supervision who are known or thought to be “Good Old Boys” and who are perceived to be closely associated with one another, and when a blind eye to enforcement of the law (City Codes & Ordinances) appears to take place in in favor of an individual, business or company…The DEFAMATION of the term “Good Old Boys” takes place.
In order to protect and remove the demeaning image from all of us who can lay claim to being or are thought to be a Good Old Boy, I recommend removing the temptation/opportunity to act in a questionable behavior in the confines of limited public exposure.  The seed of doubt is planted when the head of SELECTIVE ENFORCEMENT ARISES. When CODE ENFORCEMENT is to take place and not subjected to the Light of Day.

A CODE ENFORCEMENT COMMISSION designed to oversee enforcement application and techniques will bring Public Exposure to those charged with the duties and responsibility of seeing to it, in efforts to see that codes are applied equally and fairly. A Commission charged with the responsibility of evaluating the necessity of each code and determining the value of keeping the code on the books.      
My friends, there is a marked difference between an elected official who knowingly acts to restrict and/or remove commissions from the arsenal of Transparency and one who moves to create opportunity for the Light of Day to enter into the arena of accountability for our Elected Officials.
A CODE ENFORCEMENT COMMISSION may very well save the good name and reputation of the term, “Good Old Boy’.  Please join with me in helping to establish such a commission and supporting with your vote individuals dedicated to Transparency in City Government.

Honoring American Veterans

The men and women who have served to protect our Freedom and safeguard The Constitution of the United States of America, and thereby secure the blessings of Liberty for each and every one of us,  Deserve a place of honor at the public table. The City Council of the City of Saint George can, and is expected to provide a public forum to permit the expression of thoughts and ideas, and yes…  Even, a place to assemble and petition city government for a redress of grievances.

Let it be known that when elected I SHALL move to establish a Human Relations Commission that will include a place of Honor for those representing American Veterans that reside within our community.
A place in which Veterans can help other members of the community to better understand the American values they fought to preserve.  Veterans should not be made to go Hat in Hand, seeking recognition but out of courtesy and respect should be welcomed and invited to participate in local government activities.
A Human Relations Commission can provide a permanent venue for the gathering of citizens from all segments of the community in which Veterans can play a vital role in representing time honored values, lending expression of thoughts and ideas that will articulate issues intended to improve the quality of life for all citizens.
My friends in order to accomplish this, I earnestly solicit your support.  Asking that you SPEAK OUT.   Express your support for a HUMAN  RELATIONS COMMISSION that will provide a PERMANENT Public Forum for discussion of issues of concern to the Citizens of Saint George.

Master Planning: Whose Vision Is It to Be?

Much has been said in this election cycle about the direction the City is going. OUR planned objective, the vision on how the City is to be when it grows up and is ultimately built out to its full potential.  A travel plan if you will.

This travel plan for the City should contain not only a hint of what the goal and objective may be, but a roadmap of our intended route of travel. Sign posts, and detour signs that may redirect our travel plan must be taken into account, along with our method of travel and ability to pay. 
Who is to lead the way?    Who is steering the ship of travel?  Guiding the City to its intended destination, a destination that should have been decided by those going on the trip…The Citizens of St. George!   
I put forth this scenario seeking to capture your interest as the person paying for the trip. I believe CITIZENS should have a say in the matter.  Before we depart AND during the travel period, consulting as adjustments have to be made and most assuredly will be required.  

This is another way of saying Transparency --- Public Discussion.  YES this will take Time and Work.  IT SHOULD NOT BECOME AN INCONVENIENCE to those the public hires to get us to our intended destination.
Those given the responsibility of making the daily decisions in guiding the City should never forget that they are employed to Protect and to Serve those that are paying for the trip...The Citizens of St. George.     

The order of consideration should be 1st The People, 2nd Elected Officials, and 3rd Administrative Personnel and Staff.   The tail should not be wagging the Dog.  

When elected I will adhere to establishing Priority of Action, Accountability for Action, Transparency and Oversight provided by Citizen Participation.

Mall Drive Bridge & Virgin River

 September 19th City Council Meeting was an example of pro-active thinking. When it came time to advance Roadway Improvements…Connecting existing roads to satisfy critical transportation needs…and in the long run save Tax Dollars…The City Acted.

At first glance you may ask why; Is it not desirable to allow an existing Bond Debt to be paid off in the near future instead of extending the Bond for an additional 15 years?
Looking at the Big Picture you may feel better knowing that the Mall Bridge project was begun about two years ago. Money has been spent on Environmental Impact Studies as the City negotiated with the Federal Agency to make the Bridge over the Virgin River a reality.

The recession caused the Mall Bridge Project to be placed on hold pending completion of other major projects which required the transfer of Mall Bridge Funds to projects deemed to have a greater priority.
WHAT the general public may not know is that early negotiations with Federal Agencies included a limited time frame for completion. It has been reported at Council Workshop Meeting(s) that failure to meet the construction dates set forth would result in the termination of the authorization to build on or over Rivers such as the Virgin River.  Building permits are no longer to be issued by the Federal Government beyond a certain date and time.

Therefore, by not acting now the City is sure to lose the money already spent on impact studies and more importantly the door would be shut on all future building over the Virgin River. The opportunity to connect a large section of the City to adjoining areas would be lost.

So, let us give credit where credit is due; for clear thinking on Financial and Transportation issues.  There is still work to be done. The door of opportunity remains open for the betterment of the City.  The Future is Bright.
When elected I will continue to work closely with fellow council members in the spirit of cooperation and service to our community.

Wholesome Family Entertainment


Several months ago a couple from the State of Colorado appeared before the City Council and presented their vision of a DANCE HALL and social gathering facility.  It is now located in the Old Theater on 1000 East, just north of St. George Blvd.
This location places the Dance Facility in close proximity to Dixie State University and Student Housing.  While it is also located close to the State Liquor Store it was made VERY clear that there is to be no consumption of alcohol on the premises.  The fact that worldly attractions exist in our community great care was taken to insure that while parking is located below and away from the Dance Site…Security Guards would be in place AT ALL TIMES in the parking area and yes, security and effective supervision within the building itself.
IT IS NOW OPEN…and a welcoming event for those involved and supportive of the facility has taken place.  Reportedly the Mayor was seen dancing with city council candidate Tara Dunn.
Recognizing the value in WHOLESOME FAMILY ENTERTAINLMENT I would like to advance city council interest in supporting the St. GEORGE MUSICAL THEATER.  
SGMT would in effect supplement educational efforts, developing in YOUTH and ADULTS the value of learning and performing in the arts.  The end product produces a CITY image of a Clean, Healthy Environment. One that is sure to attract welcomed visitors and best of all provide a venue for families to enjoy and appreciate one another and be lifted in spirit.
When elected to the city council I will act to encourage the Jennings Family to continue work with SGMT and the CITY to make this a reality.  It would be appropriate to support efforts seeking philanthropic foundations to join in this effort.

Precious Water

CITY COUNCIL Workshop meetings held at City Hall, in recent past, included a presentation by Ron Thompson, General Manager of the Washington County Water Conservation District….. Development of the County Water Supply and the Lake Powell Pipeline were topics of discussion.

The thought of NOT having enough water is frightening. Especially to those who have suffered through long periods of draught and even to those who have lived long enough to know and appreciate what it would mean to our environment. OUR beautiful State of Utah, and yes, our beloved City.

Our very lives, and the quality of life we enjoy cannot be sustained without WATER and yet we continue to ask ourselves; do we want to protect ourselves against that fearful day that we find our faucets dry, that very important question, DO WE WANT WATER at any price?.......Or do we consider the COST, and act according to what we believe to be financially prudent.

There are CONSEQUENCES to whatever decision is made. WHO is to make the decision?  The VOTER?  Or, does it to continue to be those individuals who have been appointed to positions of power… THOSE who have not been elected, and therefore cannot be held accountable by the Voters.

The Washington County Water Conservancy District is made up of APPOINTED MEMBERS, who have the power to increase water rates; TAXATION WITHOUT REPRESENTATION and is therefore problematic.

Is it time for this issue to be placed on the ballot, before CITIZENS are committed to a long term obligation that is called the Lake Powell Water Pipeline?


I believe it is TIME to have elected individuals, who can be held accountable to the VOTERS sit on the Washington County Water Conservancy District BOARD OF TRUSTEES. Having said this and keeping in mind the CONSEQUENCES of our decision to move forward or not, I believe that there are Financial Limits and we cannot say “forget the cost, full speed ahead.”  Citizens should know and have a right to know the COST of the Lake Powell Pipeline and associated factors.
